TERMS OF SALE
1. Terms of sale
The owner of the online store www.elli.ee is ELLI OÜ (registry code 12911474), located at Mustamäe tee 44 a, Tallinn. The terms of sale apply to the purchase of goods between the buyer of the online store (hereinafter Consumer) and the company ELLI OÜ (hereinafter the online store www.elli.ee ).
The online store www.elli.ee reserves the right to make changes in the terms of sale and announces the changes on the website of the online store www.elli.ee. On the website www.elli.ee it is possible to pay for the goods via bank links: LHV BANK, SEB BANK, LUMINOR BANK, CREDIT BANK, SWEDBANK, DANSKE BANK. Payment in the online store is made in euros.
2. Validity of sales contract, information about goods and prices
The prices of the products sold in the online store are indicated next to the products and include 20 % VAT.
The fee for delivery of the goods depends on the location of the buyer and the manner of delivery. The delivery fee is displayed to the buyer when placing the order.
For orders from 50 euros, shipping costs are not added (Estonia).
Information about the goods is provided in the online store directly next to the goods.
3. Placing an order
To order the goods, you must add the desired products to the shopping cart.
To place an order, you must fill in the required data fields and choose the appropriate method of delivery of the products. The amount of the fee is then displayed, which can be paid via a bank link or using another payment solution.
The agreement enters into force as of the receipt of the amount due to the online store’s current account.
If it is not possible to deliver the ordered goods when the goods are out of stock or for any other reason, the buyer shall be notified as soon as possible, and the money paid (incl. the cost of delivery of the goods) shall be returned immediately, but not later than within 14 days of sending the notice.
4. Delivery
The shipping costs of the goods are borne by the buyer and the corresponding price information is displayed at the shipping method. The goods are sent via our partners’ Omniva Post Office or SmartPost.For orders whose amount is less than € 50, the shipping cost is either € 2.99 (SmartPOST) or € 3.98 (Omniva post office), according to the method chosen by the Consumer.
For all orders from 50 euros, shipping costs are not added.
Shipments within Estonia generally arrive at the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract.
5. Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract entered into in the online Store within 14 days. Depending on the products, the buyer may not have the right of withdrawal, in such a case, the corresponding products and services must be listed and must comply with the conditions listed in § 53 (4) of the Law of Obligations Act.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in such a way as is permitted for testing the goods in a physical store.
If the goods have been used for purposes other than necessary to verify the nature, characteristics and functioning of the goods or there are signs of use or wear, the online Store has the right to cut the refundable fee in accordance with the decrease in the value of the goods.
To return the goods, you must submit an application for withdrawal from the purchase, and the online store www.elli.ee upon receipt of the application for withdrawal, shall return to the consumer immediately, but not later than within 14 days, all fees received from the consumer under the contract.
The costs of returning the goods shall be borne by the buyer, unless the reason for the return lies in the fact that the thing to be returned does not correspond to the order (e.g. a wrong or defective thing). The buyer must return the goods within 14 days following the submission of the application or provide proof that he or she has delivered the goods to the carrier within the aforementioned period.
6. Right to complain
The Online Store www.elli.ee is responsible for the non-conformity or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing, and which occurs within up to two years from the date of delivery of the goods to the Consumer.
Within the first six months of the delivery of the goods to the Consumer, it is assumed that the defect was already present at the time of delivery of the goods. Refuting the corresponding assumption is a duty of the online Store www.elli.ee.
The consumer has the right to contact the online store within two months at the latest by sending an e-mail to the address info@elli.ee.
The online store is not responsible for any defects that have arisen after the delivery of the goods to the buyer. I
f the goods purchased from the online store have defects for which the online Store is responsible, the online Store will repair or replace the defective goods.
If it is not possible to repair or replace the goods, the online Store will return to the buyer all the fees associated with the sales contract.
The online store will respond to a complaint submitted by the consumer in writing or in a format that can be reproduced in writing within 15 days.
7. Privacy Policy, direct marketing and processing of personal data
The online Store uses the personal data entered by the Consumer (including name, phone number, address, email address, bank details) only for processing the order and sending the goods to the buyer by forwarding the personal data to the logistics partner for the delivery of the goods.
The online Store www.elli.ee will send newsletters and offers to the Consumer’s e-mail address only if the consumer has expressed a wish for that by entering the e-mail address on the website and has indicated his or her wish to receive direct mail notifications. The consumer can opt out of offers and newsletters sent to the e-mail at any time by notifying us by e-mail or following the instructions in the e-mail containing the offers. The security of the consumer’s personal bank identifiers is ensured by encrypted data communication with banks, and the online Store www.elli.ee has no access to this information. Elli OÜ is the controller of personal data.
Elli OÜ shall forward the personal data necessary for the execution of payments to the authorized processor Maksekeskus AS.
8. Consumer rights and dispute resolution
If the Consumer has complaints to the online store www.elli.ee, they must be sent to an e-mail address info@elli.ee.
If the Consumer and the online Store are unable to resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee.
The Consumer Disputes Committee is competent to resolve disputes arising from a contract concluded between the buyer and the online Store.
